This Privacy Policy (“Policy”) describes the personal information that AMC Networks Inc.
(“AMC”, “we”, “our”, or “us”), may collect about anyone who uses the Services (defined below) (“User”, “you”, or “your”, including, but not limited to, people who register for the Services, people who subscribe to the Services, people who browse the Services, and people who interact with us offline, such as at promotional events), how we use and share that information, and your rights and choices regarding that information. For the purposes of this Policy, “personal information” means any information that reasonably identifies, relates to, describes, or could be linked directly or indirectly to you,
your device or your household.

1. THE SCOPE OF THIS POLICY?

In this Privacy Policy, the “Services” means:

  • The services provided and made available by AMC in connection with your browsing and viewing of certain multimedia (such as movies, short films, extended episodes, bonus content, and television shows) (“Content”) through one or more of AMC’s streaming services, offerings, or channels (including, without limitation, AMC+, Acorn TV, ALLBLK, HIDIVE, Shudder, and Sundance Now) via websites, applications, or other interfaces and platforms that contain links to or otherwise reference this Privacy Policy.
  • Any other technologies, features, products, and content that we may provide through AMC user interfaces, such as AMC websites, newsletters, and any other digital property or application in which this policy is linked or referred to or appears. This Policy is incorporated into the AMC Terms of Use found here (“Terms of Use”). This Policy also applies to the personal information we collect offline and from other sources, as described below.

We may change this Policy from time to time. If we make changes, we will post the new version here and revise the “Last Updated” date above. We encourage you to review the Policy whenever you use the Services to stay informed about our information practices and the choices available to you. Use of the Services after the listed Effective Date means you agree to the current version of this Policy.

2. THE TYPE OF INFORMATION WE COLLECT?

Personal Information You Provide to Us

When you access, use, or register for the Services, or interact with us in other ways (including at our events or by contacting us directly), you may provide us with personal information. That includes, for example, personal information that you provide when subscribing to the Services, creating or updating an account, customizing your profile, making purchases, signing up to receive newsletters, posting ratings or comments, responding to surveys, setting viewing preferences or controls within the Services, or communicating with us.

We may sometimes require you to provide personal information in order to access or receive information or Services from us. For example, you may need to provide your payment card information in order to subscribe to certain services, and you will need to provide your email address in order to receive our newsletters or create an account.

You also may voluntarily share personal information with us, such as when you communicate with us or upload information to personalize an account profile.

The information you provide us may include:

  • Individual Identifiers (e.g., name, date of birth, postal or email address, phone number, account username and password);
  • Device or network identifiers (e.g., IP address, browser identifier (such as that associated with a browser “cookie”) or mobile ad identifier, further described in the below sub-section titled “Personal Information We Collect Automatically”
  • Transactional information (e.g., cable provider, Services you subscribe to, Content viewed, as well as your subscription dates and prices paid);
  • Content preferences (e.g., watch lists, preference settings, content selections);
  • Financial information (e.g., credit card information, payment history);
  • Communications content (e.g., your product ratings, comments, or questions submitted to us);
  • Geo-Location information; and
  • Demographics (e.g., age, gender, household information, education, occupation).

We may also create and access inferences of the above.  For instance, we may infer your content preferences based on your prior content accessed.

Personal Information We Collect Automatically

When you use, access, or otherwise interact with the Services, we may automatically collect certain information using cookies (i.e., small pieces of electronic information stored by your internet browser software on to your computer’s hard drive), web beacons and pixels (i.e., small pieces of data embedded in images or video on the Services), and similar technologies, collectively “Cookies.” The information we collect with Cookies includes:

  • Identifiers (e.g., device type, hardware model, operating system and version, Internet Protocol (“IP”) or MAC address, advertising identifiers (from mobile devices, tablets, and streaming media devices that include such identifiers), device IDs, or other unique identifiers);
  • Internet or other electronic activity information (e.g., how you interact with our electronic communications (such as email, push notifications, and text messaging), how you interact with the Services (such as access times, Content viewing patterns, language preferences, browser types and versions, and information about the sites or services that directed you to the Services), how you use the Services (such as browsing activities, title selections, and search queries);
  • Inferences about your preferences and characteristics derived from online activities; and
  • Location information as inferred from your IP address or other network information.

Personal Information We Obtain From Third Parties

We may also receive your personal information from other sources, such as:

  • Location resources. We engage service providers to help us determine your location from your IP address or other information to customize our services to your location and for other purposes addressed in this Policy;
  • Business partners. We may work with business partners that provide or partner with platforms on which AMC Content is offered (e.g., cable providers, connected television platforms, authorization and authentication management companies, and online video platforms that are not operated by us), which collect and handle personal information subject to their own privacy policies. We also may work with partners that help us conduct events or promotions. These partners may share certain personal information with us, which we will handle in accordance with this Policy;
  • Payment processors. We engage payment processors to assist in handling the transactions you make via the Services. These companies may provide us with personal information about your transactions (e.g., last four digits of payment card, date of approved payment, amount paid) as well as personal information that we need to fulfill your order (e.g., name, shipping address, items purchased);
  • Online and offline data providers. These companies provide us with demographic information, information about your online activities or interests inferred from those activities, inferences regarding the various devices you may use to access the Services or other online services, and other personal information (e.g., inferred age, gender, contact information, device data, types of products that may interest you);
  • Social media and other third-party platforms. You may be able to log in to certain Services using certain social media or other third-party credentials or use certain tools (e.g., like or sharing tools) on the Services. When doing so, the platforms may provide us with certain personal information (e.g., friends or contacts, profile picture, birthdate, gender, other profile-related information). Please note that the personal information we receive from third-party platforms depends on your account/privacy settings with those platforms and those platforms’ privacy policies; and
  • Gift purchasers. When other individuals purchase Services for you as a gift, we may require them to provide us with personal information about you in order for us to deliver the gift to you (e.g., email address).

3. HOW WE USE YOUR INFORMATION?

We use your personal information, as permitted by applicable law, primarily to:

  • Operate the Services, including providing you with the Content you request and remembering and understanding your preferences;
  • Process transactions that you request;
  • Improve the Services and learn about how visitors use the Services. For example, we aim to improve the Services by creating content, features, and interfaces that reflect consumer interests as inferred by user activity, and to better tailor your experience with the Services to match your preferences;
  • Respond to your requests for information;
  • Communicate with you, including communications about the status of your account or your purchases, such as emailing you regarding payments or subscription terms, contacting you regarding shipping for purchases, notifying you when your subscription is about to expire, or notifying you of changes to this Policy or our Terms of Use, or to communicate about our Content, products and Services, or the products and services offered by third parties, such as information about Content and features on the Services, new releases, or available streaming platforms. You can always opt out of receiving marketing communications by following the steps described in Section 7 below;
  • Identify, prevent, and investigate activities that may be illegal or prohibited, including fraud and violations of our terms of use;
  • Comply with legal obligations, such as those involving Content restrictions, consent management, and legally required notices;
  • Protect our rights, your rights, and the rights of others;
  • Learn or make inferences about your interests or how you use the Services, in connection with identifying how to expand our business opportunities and deliver the Content, services, and features that you wish to use and interact with, including by linking your activities across the devices you may use;
  • Administer your participation in contests or other promotions;
  • Personalize your experience and customize the Content you receive; and
  • Advertise and market to you, including across other websites and platforms, on behalf of ourselves and our trusted partners, including targeted advertising. For example, we may use information about your general location to present local Content to you or we may use the inferences we have drawn about your interests to provide personalized recommendations, marketing, or other content to you via the Services. If you view certain Content on the Services, we may deliver ads related to that Content on the Services or other online platforms. And we or third parties may collect information about your online activities over time and across various online services to infer your interests. We may use that information to deliver relevant advertising to you on the Services or other online platforms, whether regarding our own services or those of other companies, such as advertisers or Content creators. In addition to the data uses identified above, we may aggregate or deidentify information we have collected so that it no longer reasonably identifies you, and we may use and disclose such information for any purpose not otherwise restricted by law, including, without limitation, in statistical analyses to help us analyze patterns in the use of the Services.

Automated Processing

When we analyze the information we collect for advertising, marketing, security, and fraud prevention, we use automated processes to identify or predict potential risks or outcomes. For example, we may use the information you provide us and information about your online activities to infer your interests. And we use those inferences to make automated decisions or recommendations about the Content and offers we present to you on our digital properties. We use automated tools to identify suspicious activities associated with the Services. We may also use automated tools to provide or improve our services, such as to detect ad breaks in programming. These automated processing activities will not, without human intervention, have legal or similar effects for you.

4. HOW WE SHARE YOUR INFORMATION

We may share your personal information with:

  • Group Companies. AMC may share your personal information among our group entities and affiliates in order to provide you with access to various Services, to provide a consistent experience across various AMC entities’ websites and applications, to learn about your interests, to identify new Content and services that may be of interest, and to deliver relevant or interest-based Content and communications.
  • Service Providers. We engage service providers to assist us in providing the Services and conducting other business operations. For example, we may use service providers to store our digital Content, deliver marketing communications, personalize and optimize the Services, analyze data about users’ interactions with our services, administer and process surveys or other research, process transactions, or to collect debts.
  • Advertising, Marketing, and Analytics Partners. We may share your personal information in connection with our delivery of ads within the Services. This may include, for example, advertisers or their agencies, advertising and identity technology companies that facilitate or enable the identification and delivery of interest-based advertising or that analyze the effectiveness of those advertisements. We also engage third parties to help us draft and distribute marketing, advertising, and other communications. We may share information with these companies to determine the appropriate content for these communications, identify you across various devices and platforms, as well as to deliver the communication to you.
  • Third parties as required by law. We will share your personal information to comply with laws to which we are subject, for example, in response to a court order or subpoena or a valid request from law enforcement.
  • Third parties for other purposes. We may share your personal information with other third parties consistent with applicable law, including to protect our rights; enforce our Terms of Use; detect, prevent, or respond to fraud, intellectual property infringement, or other illegal activities; and protect the safety and security of any person or entity, or of the Services or tangible or intangible property belonging to us or a related third party.
  • Corporate Transaction Partners. We may share any of the information we collect about you to the extent reasonably necessary to proceed with the consideration, negotiation, or completion of a merger, reorganization, or acquisition of our business, or a sale, liquidation, or transfer of some or all of our assets.
  • Other business partners. We will share information about you with third parties when you engage in certain activities on the Services that are sponsored by third parties. For example, you may choose to purchase Content or products offered by a third party or elect to receive information or communications from a third party.
  • Social media and other third-party platforms, for example, when you log in to your AMC streaming service account using third-party platform credentials, when you interact with social media tools on the Services, or when you visit the Services while logged into social media or other third-party platform accounts, the platforms may collect information about your interactions with the Services. Please note that if you interact with social media on our Services (for example, by clicking on a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity. To control this sharing of information, please review the privacy policy of the relevant social media or third-party platform. Social media platforms and other third parties may also collect information about you via pixels, cookies, or other tracking technologies used on the Services.   • The public, when you submit content to public areas of the Services. Various areas of the Services allow you to submit user content, such as ratings and reviews, comments, questions, and forum discussions. Any information supplied by you in these public areas of the Services is widely accessible and available to the public. We are not responsible for the information you voluntarily publish for public viewing through any Services.

5. RETENTION OF INFORMATION

We retain your personal information for as long as is necessary to carry out the purposes set out in this Policy, unless a longer retention period is required by applicable law or is necessary for us to protect our rights. We keep your personal information for at least as long you maintain an AMC streaming service account or subscription. When your account or subscription is over, we may retain certain personal information for purposes such as complying with our legal obligations, resolving disputes, preventing fraud or misuse of promotions, and protecting our rights and interests. We may be legally obligated, for example by tax and sales laws, to retain personal information related to product or subscription purchases for a period of time specified by law.

We use technical, administrative, and physical security safeguards designed to protect the information that we collect or receive against loss and unauthorized access, use, modification, or disclosure. Please be aware that, despite our ongoing efforts, no security measures are perfect or impenetrable. Moreover, we are not responsible for the security of information that you transmit to us over networks that we do not control, including Internet and wireless networks.

7. YOUR CHOICES AND RIGHTS

You may have certain choices when it comes to how we collect and use your personal information:

  • Account Information. If you have an account with us, please visit the My Account page on the relevant Service to update your personal information and payment method.
  • Email Marketing. If you no longer wish to receive marketing communications from us, you can click the unsubscribe link in an email you receive from us or using other unsubscribe features that we provide in our marketing communications.   • Online Activity Tracking and Interest-Based Advertising. You have several options to either prevent our collection of information regarding your online activity, or prevent third parties from using such information from being used for interest-based advertisements:
    • You can opt out or set preferences regarding Cookies when a device you utilize visits the Services, by accessing our cookie management tool at the footer of each website. Please note that you will need to set preferences on each device you use to visit the Services.
    • You may also modify your browser setting to disable or reject cookies across the internet; but if you do so, some features of our website or Services may not function properly or be available.
      • If you are using the Services on a mobile device, the operating system of the device may offer you options regarding how the device collects and uses your information for interest-based advertising. Please visit https://thenai.org/opt-out/mobile-opt-out/ for more information.

    • You may be able to prevent third parties from using your information for interest-based advertisements across the internet by visiting industry trade group sites at http://www.networkadvertising.org (hosted by the Network Advertising Initiative) or http://www.aboutads.info (hosted by the Digital Advertising Alliance). Please note this does not opt you out of being served ads, nor will it prevent the receipt of interest-based advertising from other companies that do not participate in these programs.

Any information you provide via those websites or applications is subject to the privacy policies of those third parties and is not covered by this Policy. These links are provided to you for convenience purposes only, and you access them at your own risk. Please refer to our Terms of Use for further details.

If you follow a link to or are linked to another AMC entity website, such as an entity based in the European Union, please note that the website or related services may be associated with a different privacy policy, in which case that policy will govern the handling of your information with respect to that particular AMC entity or offering. In addition, some of our e-commerce websites or microsites are managed by third parties, and those pages may be associated with a different privacy policy, in which case that policy will govern the handling of your information with respect to that e-commerce website or microsite.

10. WHERE PERSONAL INFORMATION IS PROCESSED

We generally process information in and subject to the laws of the United States, which may not provide the same level of protection for your information as your home country.

In some cases, your information may be transferred to, stored, and processed in a country that is not regarded as ensuring an adequate level of protection for information under applicable laws. When we conduct such transfers, we put in place appropriate safeguards (such as standard contractual clauses) in accordance with applicable legal requirements.

12. CHILDREN’S INFORMATION

We do not knowingly or intentionally gather personal information about children.  If we have inadvertently collected the personal information of a child under 18, or equivalent minimum age depending on jurisdiction, a parent or guardian of that child may contact us at privacy@amcnetworks.com to request that we delete the information from our records or otherwise cease the use of that information.

13. ADDITIONAL NOTICES

 13.1    YOUR RIGHTS UNDER THE LAWS OF CERTAIN U.S. STATES INCLUDING CALIFORNIA

The laws of certain U.S. states provide their residents with certain rights to access, delete, and correct certain personal information we collect about you, as well as to restrict the use of personal information for personalized advertising, restrict the “sale” of personal information, and control our use of personal information considered sensitive (“U.S. State Comprehensive Privacy Laws”). We will not discriminate against you for exercising these options.

Residents of the State of Nevada have the right to opt out of the sale of certain pieces of their information to third parties who will sell or license their information to others. If you are a Nevada resident and would like to make such a request, please email privacy@amcnetworks.com.

If you are a resident of a U.S. state with a U.S. State Comprehensive Privacy Law in effect, this section applies.

Right to Know and Request Access to, Correction of, and Deletion of Personal Information

You have the right to request access to personal information collected about you in a portable format and to receive information regarding the source of that information, the purposes for which we collect it, and the third parties and service providers with whom we share it. You also have the right to request we correct inaccurate personal information and to request, in certain circumstances, that we delete any that we have collected directly from you, provided that we may retain your personal information for certain purposes, such as where we have a legal, compliance, auditing, or security-related basis to do so.

You may submit a request to exercise your rights to know/access, correct, or delete your personal information by sending an email to the email address listed in Section 7 that is associated with your Service. You may authorize another individual or a business, called an authorized agent, to make requests on your behalf through these means, provided those agents comply with requirements of the applicable state, which may include a written authorization and/or a power of attorney for certain requests.

In order to process your request, we may need to verify your request. We may do this by asking you to provide personal identifiers we can match against information we may have collected from you previously and confirm your request using the email account stated in the request.

We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

Right to Opt Out of Personalized Advertising and Sale to Third Parties

You have the right to opt out of the use and disclosure of your personal information for the purposes of selecting or delivering advertising based on your activity over time and across different online platforms. U.S. residents may also have the right to opt out of certain disclosures that are considered “sales” or “shares” under applicable state laws. To review our Notice of Right to Opt Out of Sale/Sharing and exercise your right, please click the “Do Not Sell or Share My Personal Information” link at the footer of https://www.amcnetworks.com/. Please note that your right to opt out does not apply to our disclosure of personal information to service providers, as described above.

Right to Limit Use of Sensitive Personal Information

At this time, we do not collect and disclose sensitive personal information for any purpose that would require offering a choice to limit its use.

Right to Opt Out of Automated Decision-making

At this time, we do not use personal information to make automated decisions about you in any situations where you may have a legal right to opt out.

Right to Appeal

In certain states, you may have a right to appeal a decision that we make, such as if we reject or partially reject a privacy-related request you have made.  If you wish to do so, you may email us at privacy@amcnetworks.com.

13.1.1.   SPECIAL INFORMATION FOR CALIFORNIA RESIDENTS

Your California Privacy Rights

California’s “Shine the Light” law permits customers in California to request certain details about how certain types of their information are shared with third parties for those third parties’ own direct marketing purposes (or to permit an opt out from such sharing).  If you are a California resident, you may opt-out of such sharing by emailing us at privacy@amcnetworks.com or mailing a written request to AMC Networks Inc., 11 Penn Plaza, New York, NY 10001, Attn: Privacy Legal.

Notice of Financial Incentive

Some of our Services offer a reduced-price subscription tier (“Ad-Supported Tier”) that is supported by advertisements, which may be inserted before, during, or after the content available on the Service. This may be considered a “financial incentive” under California law because the operation of these advertisements, including selection, service, and measurement, use personal information. Ad-Supported Tier subscribers may not be able to access or use certain functionality available to full-priced subscribers, such as downloading content for offline viewing or viewing content in certain geographical regions. You will be able to choose your preferred tier at signup, and you can change subscription plans at any time (to or from Ad-Supported Tier) by visiting your subscription management page. If you change from Ad-Supported Tier to a different tier, the cost of your subscription may increase.

We believe that the Ad-Supported Tier gives consumers more flexibility on pricing options by offering our advertising partners the ability to better leverage the reach and appeal of our content, which can help to offset lower subscription costs. When we determine the amount of the price reduction for the Ad-Supported Tier, the factors we take into account include the advertising revenue projected to be generated through the Ad-Supported Tier, the context of the Company’s overall revenue goals, and the price differential elsewhere in the marketplace between premium subscriptions and ad-supported subscriptions.

Collection, Use, and Retention

You have the right to receive notice of the categories of personal information we collect, and the purposes for which those categories of will be used.

The following chart describes our practices with regard to the collection, use, and retention of your personal information.

The categories we use to describe the information are those listed in the CCPA. Certain personal information may fall into multiple categories, and in some circumstances, how we use and how long we keep the information within each category will vary.

We retain your personal information for as long as is necessary to carry out the purposes set out in this Policy. Our retention of personal information is based on many factors, including the nature of your use of the Services (for example, whether you are a subscriber to an AMC Service); the nature of the personal information; and legal compliance.

Sale, Sharing, and Other Disclosure of Personal Information

Any category of personal information listed in the chart above may be disclosed for a business purpose to service providers and contractors, which are companies or individuals that we engage to conduct activities on our behalf. California law also requires us to provide you with information regarding the parties to whom we “sell” or “share” your information, and the parties to who we disclose your information for a business purpose. Under the CCPA, a business “sells” personal information when it discloses personal information to a company for monetary or other valuable benefit, and a business “shares” personal information when it uses it for cross-contextual behavioral advertising. A company may be considered a third party either because the purpose for its sharing of personal information is not for an enumerated business purpose under applicable law, or because its contract does not restrict it from using personal information for other purposes.

            13.2    INDIVIDUALS IN THE EEA, SWITZERLAND, OR THE UK

The EU General Data Protection Regulation and the UK General Data Protection Regulation provide individuals located in the EEA, United Kingdom, and Switzerland the rights to receive notice regarding the purposes for which your data are processed and the legal basis for our processing, the categories of recipients of your personal information, whether the personal information will be transferred outside these jurisdictions, and the criteria we use to determine how long to retain your data. You also have the right to receive notice about your rights. These rights apply to all individuals in these locations, regardless of whether you are a customer, business contact, or member of the workforce.

The GDPR defines “Personal Data” to mean “any information that is linked or reasonably linkable to an identified or identifiable natural person.” When we use the term “personal information” in our Privacy Policy, it includes Personal Data covered by this definition.

Right to be Informed

The general section of this Privacy Policy describes the types of personal information we collect, how we collect it, and how we use it. For information on our retention practices, please see Retention of Your Information above.

We rely on a variety of legal bases to process your personal information. We mainly process your personal information because it is necessary to perform our agreement to provide the Services to you or because the processing is necessary for our legitimate interests where those interests do not override your fundamental rights and freedoms related to data privacy. Where we rely on legitimate interest as this lawful basis, our legitimate interest is promoting our business, improving the services we offer to you and your experience when you interact with us, and ensuring effective operational management and internal administration of our business and the exercise of our rights. In limited circumstances, we may rely on other legal bases for processing your personal information, including when necessary to comply with a legal obligation or where you provide your consent for processing.

Certain personal information may be transferred to and processed in the U.S. and other countries where we have facilities or in which we engage service providers. The laws in the U.S. regarding personal information may be different from the laws of your state or country. Any such transfers will comply with safeguards as required by relevant law. By using the Services, you consent to the collection, international transfer, storage, and processing of your data.

Right of access, right to data portability, right to request correction, and right to request deletion of personal information

You have the right to request that we:

  • Give you access to, and a copy of your personal information that we hold in our systems;
  • Correct or update inaccurate or incomplete personal information we have about you; and
  • Delete all or some of the personal information we have about you (e.g., if it is no longer needed to provide Services to you).

You may submit a request to exercise your rights to know/access or delete your personal information by sending an email to the customer support email address for your Service that is set forth in Section 7. We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response. Please note that, in order to verify your identity, we may require you to provide us with additional information prior to accessing any records containing information about you.

Right to object, withdraw consent, and restrict processing

You have the right to request that we:

  • Stop using, and ensure that all third parties stop using, some or all of your personal information (e.g., if we no longer have a legal basis to process it); and
  • Stop contacting you with promotional messages.

Right to opt out of automated processing

You have the right to opt-out of automated processing where such processing would produce legal or other similarly significant effects. We do not use personal information of residents of the EEA, Switzerland, and United Kingdom to make automated decisions about you that would have these effects.

Lodging a Complaint

            13.3    INDIVIDUALS IN OTHER COUNTRIES

Subject to the geographic availability of the Services, residents of other countries, including Canada, Australia, and New Zealand, may have certain rights related to the collection and processing of your personal information. You may have the following rights (subject to local law): (i) right of confirmation (right to confirm the existing of the processing of your data); (ii) right to access your personal information; (iii) to correct personal information; (iv) request deletion of personal information; (v) restrict our use of personal information; (vi) object to certain uses of personal information; (vii) receive personal information in a usable electronic format and transmit it to a third party (also known as the right of data portability); (viii) right to review decisions (when applicable, you have the right to request a review of decisions made solely on the basis of automated processing of your personal information affecting your interests); (ix) lodge a complaint with a local data protection authority; or (x) withdraw any consent supporting uses or disclosures of personal information.
